The Workshop

Each delegate will receive a paper copy of the new Act and Rod will work through the key areas, taking a look at how the new law can be applied in practice to improve sales and claims for clients to include the following and much more:

  • briefly review the traditional law of disclosing materials facts
  • reasons for the new Act together with its main provisions
  • the continued importance of existing case law
  • brokers "fair presentations" of risks, now & after August 2016
  • Insureds' "senior management" and other responsible persons
  • delimiting the persons questioned and listed in a presentation
  • the need to search for relevant information, brokers' knowledge
  • old & new law of Warranties, Conditions & other Clauses
  • why and when Insureds will need their own forensic advice
  • grading and using insurers' four remedies for unfair presentations
  • is this the end of "holding covered" and "average"

Rod will also touch on the coming major changes that affect us all in the Enterprise Bill 2015, in respect of damages of late payment of claims

Learning Objectives

After attending this half day course delegates should:

  • have a good understanding of the new Insurance Act
  • be able to prepare a "fair presentation" and offer terms of cover accordingly
  • know the Insured's and Insurer's legal duties at underwriting stage
  • understand the concept and importance of "senior management"
  • be able to grade and apply Insurers' four remedies
  • handle breaches of warranty confidently
  • assess the legal effects of breaches of all policy terms
  • help clients, customers and colleagues comply with the Act

Rod Smith FCII FCILA is a CII-Accredited Advanced Technical Trainer. Rod has worked in insurance claims for over 40 years and uses his experience to train students of CII exams and other insurance staff in insurance law and business interruption
