Lee Ingram will present a talk concerning the recent Jersey Royal Court case of Dr Hayden Taylor v Canopius Underwriting Limited & ors., where he court took the opportunity to examine the relationships between an underwriter, broker and loss adjuster for the three parties ad examined the contractual and tortious relationships with the Plaintiff.

The Plaintiff's claim arose out of the occupation of the property and the material insurance arrangements which were in place during the currency of two separate claims. Both claims were accepted and paid by the underwriter however it was the claim for alternative accommodation which troubled the court. The judgement provides an interesting insight from a different, but connected legal jurisdiction, to its view of the doctrine of utmost good faith: the wider duty of good faith seen in other jurisdictions and the duties owed by the parties in Contract and Tort. lee will also discuss the extent of a brokers responsibilities to both underwriter and Plaintiff.
