Norman Hay PLC v Marsh Ltd [2024] EWHC 1039 (Comm)

Please join us for this very interesting seminar where Lee will discuss the effect and lessons to be learnt following the Court of Appeal decision in Norman Hay PLC v Marsh Ltd [2024] EWHC 1039 (Comm).

The case has significant implications for brokers and their professional indemnity insurers because the Court of Appeal found that the Court’s assessment of causation and loss must involve considering the ‘loss of chance’ aspect and whether the putative insurer would have engaged in dealing with the underlying claim against the claimant and whether it would have provided an indemnity of some sort; even where no cover had been suggested by the broker.

This case follows on from the wave of cases now being brought by claimants seeking redress against brokers for not assessing their risks and insurance needs properly or fully.

Complimentary drinks and snacks will be available from 5.30pm and Lee will begin the seminar at 6pm for a duration of approximately 1 hour. After the seminar, there will be a chance to network and meet the current local council representatives.
