Overview

The dawn of the Enterprise Act 2016 opened the door for policy holders to claim damages from their insurers where payment of their claims has been unreasonably delayed. This term is implied into insurance policies incepted and renewed after 4 May 2017, by s.13A Insurance Act 2015.

We will discuss the implications of this new legislation for insurers, loss adjusters, brokers and claims teams across the insurance industry.

Learning Objectives

This Seminar will:

  • Provide an overview and consider the implications of key aspects of the Act – how and when will a claim against insurers arise?

  • Identify types of claims/policies where the issues thrown up by the Act are most likely to arise.

  • Discuss what you can do in terms of your practice, procedure, and systems to mitigate the potential for unreasonable delays.

  • Look at the issues insurers/claims handlers/brokers need to be reviewing, ahead of the Act coming into force.

  • Discuss the feasibility of contracting out/limiting liability.

  • Consider the defences to damages for late payment claims when they arise.

Presented by Sarah Trendell-Smyth (Principal Associate) and Kelly Barnett (Senior Associate) at Mills & Reeve LLP.

Sarah is a professional indemnity lawyer with more than 20 years’ experience of acting for brokers, loss adjusters , solicitors, and their Insurers in defence of claims made against them.

Kelly specialises in defending professional negligence claims made against solicitors, construction professionals and loss adjusters, and completed an 11 month secondment to a large insurance broker, handling claims as a third party agent for insurers.
