The current law relating to fraudulent claims and the future: A paler shade of grey?

This free interactive and thought-provoking seminar traces the historical development of the fraudulent claims rule and then focuses in particular on the provisions of the Insurance Act 2015, as well as the recent decision of the Court of Appeal in Versloot Dredging BV v HDI - Gerling Industrie Versicherung AG (The DC Merwestone) relating to fraudulent devices.

Learning Objectives
By the end of this session delegates will be able to describe:

  • Identify the key elements of the fraudulent claims rule and its historical development
  • Recognise the main categories of fraudulent claims and the most up to date decisions of the courts relating to each
  • Understand the relevant provisions of the Insurance Act 2015 and how these will impact on how an insurer may deal with fraudulent claims and their remedies available to an insurer
  • Apply the knowledge gained from the seminar to deal more effectively with, and find practical solutions to, the types of fraudulent claims that are typically encountered by an insurer
  • Critically analyse the current state of the law relating to fraudulent claims and find novel solutionsto any remaining grey areas

Speaker Biography

Jeff Heasman is Director for Legal & Insurance Programmes Worldwide at The Pyramid Group. Educated to Masters level in International maritime law (including insurance law), Jeff spent many years working as a litigation executive dealing with cases up to the Court of Appeal and also worked with Crawford & Company as a Senior Liability adjuster. Since that time Jeff has been a lecturer in the law of torts and Dean of the Faculty of Law at Cavendish University in Zambia as well as a Tutor at Swansea University, preparing international students for teh study of law in the UK at Bachelors and masters level. Jeff provides training in insurance law and practice to some of the world's most prestigious organisations in various locations across the globe
