Alan Chandler, Chartered Insurer, will look at how firms have been treating customers unfairly including some disturbing case studies. The presentation will include how the FCA defines vulnerable customers, the measures all firms are expected to put in place and how the requirements on all firms have changed to make sure the most vulnerable are protected going forward.

On 19 February 2021, the Supreme Court delivered its judgment in the Uber test case. The decision will have major ramifications for the so-called “gig economy”, and in turn, future underwriting considerations. The Supreme Court judgment provides guidance on when the law now considers someone to be a “worker” and when someone is deemed to be “working”. Furthermore, when combined with an analysis of the Supreme Court judgments in April 2020 relating to an employer´s vicarious liability for their employees, the ramifications are potentially massive. The potential reach of the principles involved in the case are vast and will almost certainly impact the way many of us work now and in the future. This webinar will analyse the Uber test case and its implications for future underwriting considerations.
View event detailsUtility extensions - a repeat of the pandemic expectation issues
The FCA Test case showcased the range of different perceptions about the scope of disease cover. There are residual issues that are likely to litigate but we broadly know where we stand on the core issues. But misunderstandings about business extensions are not limited to disease covers – in particular, utility failure cover is provided generally on two fundamentally different bases (with a hybrid variant for good measure), threatens aggregation over a wide area if there were to be an extensive power outage, and would inevitably reveal misunderstandings about the extent to which the loss of internet sales might or might not be covered. In the light of the above, this session will explore aspects of a power outage scenario and highlight the potential for further disputes mirroring that over covid-19.

On 15 January 2021, the Supreme Court held in the FCA Test Case that the Orient- Express Hotels case had been wrongly decided. Proximate cause has long been an issue that the courts have grappled with and as a result this has caused confusion and uncertainty throughout the insurance industry. In this webinar, Jeff Heasman will use his vast experience as a lecturer in tort law and insurance law to strip proximate cause back to the basic principles, trace its development up until the Supreme Court decision on 15 January 2021 and then provide views on what impact the decision will have on underwriting considerations going forward.
