Event Overview

Child abuse is one of highest priority issues facing the current government. Theresa May then as Home Secretary set up the Independent Inquiry into Child Sexual Abuse (IICSA). This is investigating both historic child abuse and current problems like grooming and exploitation.

The recent disclosures of abuse suffered by young boys at the hands of football coaches has added further to the many previous disclosures of abuse which occurred in children’s’ homes, schools and families.

This presentation is aimed to provide people with an insight into these horrendous crimes and illustrate the part that insurance has to play in providing indemnity to Insureds and more importantly compensation to victims and survivors

Learning Outcomes

The presentation will focus on local authority involvement is there claims, but many aspects will equally apply to other organisations and employers. It will explain and the attendees will have an understanding of:-

  • The nature of abuse suffered by victims and survivors, where such abuse occurred and who it was perpetrated by.

  • The basis of legal liability for abuse claims.

  • Insurance Policy Cover.

  • How the law has developed in respect of negligence, vicarious liability and non-delegable duty.

  • How liability is decided.

  • Limitation.

  • The heads of loss which are claimed.

  • Causation.

  • How claims are valued.

  • Apologies and confidentiality agreements.

  • IICSA.

About the speaker

Rod has been handling insurance claims for over 40 years. Starting out at Eagle Star, then Zurich Insurance and finally, joining Municipal Mutual Insurance just over two years ago.

Hi experience spans private and commercial property and motor, but mainly liability claims, employers’ and public liability, construction risks and particularly local authority liabilities, including land charges, official’s indemnity and libel and slander.

He worked in the Head Office of Zurich Municipal in Farnborough, following which he moved to the CAT PI Team and then to manager of the Zurich Industrial Disease Claims Team in Birmingham.

In 2014 he joined MMI as Claims and Reinsurance Manager responsible for managing the run-off of claims, predominantly disease and historic child abuse. He has been involved in a number of high profile claims, like the Barrow Legionnaires outbreak in 2002 and currently is involved in NA v Nottinghamshire County Council which is going to the Supreme Court in February 2017.
