People don't get paid to do their jobs wrongly, never mind negligently or even recklessly. Time and effort goes into careful recruitment, induction, training and supervision. And then it can still go wrong. Sometimes even "criminally" wrong.

In the space of a lunchtime session Chris Gough will explore and refresh some of the principles underpinning the employer's liability for the actions/inactions of its workforce. Chris will explore the furthest boundary of this sometimes overlooked concept, and the factors that can raise a duty on employer for criminal actions undertaken in the course of the working day.

Learning Objectives: By the end of this session, delegates will be able to identify: . the concept of vicarious liability and its emergence as a legal principle . the circumstances in which the fact of "employment" should realistically be disputed . the principles that help determine that "fact of employment" . how far those principles can be stretched by the court to establish a "duty of care" and a route to compensation even for the most violent of actions
