The presentation will be considering a case study concerning a claim in which insurers challenge a policyholder’s right to an indemnity following a fire and the issues this common scenario raises for brokers. It will look at issues including risk presentation, warranties and conditions precedent in light of the Insurance Act 2015 and recent case law.

Learning Objectives:

Understand a broker’s duties with regard to risk presentation and advising on key policy terms and the steps a broker can take to mitigate against the risk of a claim.

James Thompson is a Principal associate in Mills & Reeve’s Insurance Disputes practice. He specialises in defending insurance brokers and intermediaries and acts for a number of national and international brokers and their insurers. James also advises insurers in relation to policy coverage issues.
