New SMCR and Conduct Rules plus Non-Financial Misconduct Matters

The Senior Managers & Certification Regime is one of the most important set of requirements issued by the Financial Conduct Authority (FCA). The regime creates a culture of accountability within firms from the top down, with the onus placed on individuals to take responsibility for their actions or inactions.

Senior managers have a duty of responsibility under the regime, meaning that if their firm breaches a requirement, they could be held personally accountable if they did not take reasonable steps to prevent the breach or failed to act when they should have done so. This session explores this duty and steps that can be taken to prevent regulatory action.

This session explains the expectations on senior managers and how to manage your responsibilities in accordance with these requirements and will include the new rules that were published on 22 April 2026 plus what the new rules on Non-Financial Misconduct mean (and these come into force on 1 September 2026).

Branko will give an overview on what changes are needed and, in addition, what all front line staff should be aware of as they are also personally accountable to the FCA.

  • Fit and Proper requirements;
  • Conduct rules that apply to all relevant staff;
  • Additional factors when considering Non-Financial Misconduct.

Speaker bio

I started my insurance career in 1987 and have worked across the sector including stints at PwC and GISC and have led my own consultancy practice since 2004 working closely with AMII, BIBA and the CII and have provided hundreds of well-received (even entertaining!) talks. I am a recipient of the Thomson Reuters Compliance Personality of the Year Award, the London Market People Award for Legal and Compliance and have been Highly Commended in the CII Public Trust Awards.  I have judged many insurance awards and am always being covered by Insurance Post and Insurance Times for my forthright commentary and analysis.
