Objectives:
- To understand how corporate manslaughter liability arises in a haulage context, including the legal tests applied by the court and the role of senior management decision‑making in establishing organisational culpability.
- To appreciate the interaction between health and safety failings and O‑licensing obligations, and how regulatory breaches can escalate into criminal enforcement and corporate manslaughter proceedings.
- To observe the practical conduct of a corporate manslaughter prosecution and defence, including evidential challenges, witness examination, and the strategic considerations influencing trial outcomes.
- To identify common operational and governance failures within haulage businesses that increase exposure to enforcement action, enabling more informed risk management and compliance advice.
- To enhance understanding of the potential legal, regulatory, and reputational consequences for organisations and directors following serious incidents, and how early intervention and compliance culture can mitigate risk.
