Is “the day in court” an inevitable conclusion to a dispute where both parties have paid for legal advice which tells them separately, they each have a good case? They can’t both be right!

Mediation has been part of the insurance process in Alternative Dispute Resolution for many years, however it still isn’t in use as much as was envisaged and many insurance professionals have only come across the process a few times in their career.

If you have clients in dispute, when is the right time to raise it with them and do you understand the process well enough to explain and discuss how and why it should be a consideration?

This short introduction explains how Mediation fits in to an insurance dispute and how you might help your client. Cost and confidentiality provide strong arguments to considering mediation, we can look at some practical examples of fictional cases which might help you identify when is the right time to raise this with the parties and allow life and business to move forward.

It’s good to talk, and see things from another point of view, the solution isn’t always financial sometimes people just want to be heard.

  • Understand the process of Mediation and where it fits within dispute resolution
  • Explore how the concept might be discussed between parties in dispute.
  • Appreciate how the process works and how to make clients engage.
  • How mediation might help reach an agreement, and the part you might play.
  • What an agreement means and if it does not go according to plan how to proceed.

Leading the Event

Karen Brown from Mediation - Commercial decisions by agreement will host the event, she is ACII qualified and a chartered Insurance Broker. She has worked in London, the South East and the local Bristol market for Insurance Companies, Local, National, and International Broking Houses. She now runs her own mediation and training business, a past president of the Insurance Institute of Bristol she is a member of Council and works with the Education Committee.
