This Act has altered the landscape with regard to EL claims handling, given its impact on regulatory instruments enacted under the Health & Safety at Work Etc Act 1974 and taken us back to common law principles.
The presentation will cover off the amendments to civil liability for breach of statutory duty, changes on onus of proof, exceptions to the ‘new’ rules, consider previous case law examples which may now be decided differently due to ERRA 2013 and assess its impact on EL claims generally.
