Belgrave Rooms, Nottingham
Thursday, 28 January 2016
12:15 pm – 2:00 pm (UK time)

Chris Gough - Mills & Reeve LLP

Having taken a tour of some of the key issues in the context of claims by lawful visitors (23 September 2015) Chris Gough of Mills and Reeve will be back with us to address the duties owed even to those people who are “trespassers” on our premises.

Chris will help identify:-

  • The standard of care owed to trespassers

  • The subjective state of knowledge of the Occupier in assessing liability

  • How and when a visitor can turn themselves into a “trespasser”

  • Practical examples and a case study to highlight potential liability issues

  • A checklist of “claims defensibility” features every investigation should be looking to address.

Learning Objectives

  • Differentiating visitor and trespasser claimants

  • Clarifying the duties owed and where they differ

  • A tactical awareness of opportunities to defend trespasser claims

  • Acquiring practical insight into structuring an investigation
