The case provides further guidance as to what should be taken into account when considering scope of cover and especially proximate cause and exclusions. In this session, Jeff Heasman will examine the key aspects of the judgment and its impact on insureds and insurers.

Outcomes-Based Regulation: understanding how to work in the new regulatory environment
With the introduction of the new Consumer Duty, the FCA signalled a move towards an outcomesbased regulatory system. This session will address the following questions - What does this mean for firms? What differences will we see? How do we need to adapt the way we work to evidence compliance in this new regime?

The FCA has made it clear that "some firms may be further behind in their thinking and planning for the Duty. This brings a risk that they may not be ready in time, or they may struggle to embed the Duty effectively throughout their business." A recent review highlighted three key areas where firms should particularly focus their attention during the second half of the implementation period (to 31 July 2023):- 1) Effective prioritisation; 2) Embedding the substantive requirements; 3) Working with other firms (many firms need to work and share information with other firms in the distribution chain but some plans gave little focus to this area). A 13 page letter on 13 February 2023 makes things even clearer! This General Insurance focused session will also include an update on Product Value Assessments (note the FCA criticised insurers for their lack of progress with this). Both brokers and insurers have an important role to play and this session will ensure you understand what it is you have to do and what changes need to happen in year two of the process to ensure it all gets done. We will also cover the current position on multi-occupancy insurances following intervention by the government.

Unconscious Bias
An unconscious or cognitive bias is a systematic thinking error that causes us to make poor decisions and judgments, often taking the form of social stereotypes. To make sense of the infinite complexity of the world, our brain has to take short-cuts, like categorising people into groups with expected traits. The downside is the potential for prejudice which can ultimately lead to institutionalised racism and gender bias.

WEBINAR - Understanding the basics of regulation in the insurance industry
This webinar looks to provide an overview of the history of regulation within the UK insurance industry, who are the main regulators, how do they regulate and why regulation is so essential. The presentation will examine the principle-based approach to regulation put in place by the UK regulators and how this differs from rules based regulation in many other countries. it will also look at the main aspects of regulation including fair treatment for customer, ICOBS, training and competence requirements and solvency margins. All staff need to have an overview of how regulation applies to the insurance industry within which they work, and this presentation will provide this overview.
