Session Overview: 

A lasting power of attorney (LPA) is a legal document that lets you (the ‘donor’) appoint one or more people (known as ‘attorneys’) to help you make decisions or to make decisions on your behalf.

This gives you more control over what happens to you if you have an accident or an illness and cannot make your own decisions (you ‘lack mental capacity’). This session will explain all you need to know about setting up LPA’s for your clients.

Learning objectives

By the end of this session the attendees will understand:

  • The difference between EPA's v LPA's

  •         The new documents

  •         Mental Capacity Act 

  •         How to assist your clients

Peter Barton-Managing Director-Barton Law

Peter specialises in advising clients on Equity Release Schemes.

He has 24 years’ hands-on practical experience and knowledge of working in the lifetime mortgage sector and has advised on hundreds of Equity Release transactions.

Prior to launching Barton Law, Peter was Head of the Equity Release department at Ashfords LLP, one of the largest teams of its kind in the country winning national awards for the quality of its work in equity release and reversion plans.

Peter is a co-founder of the Equity Release Solicitors Alliance and a prominent member of the Equity Release Council.

He’s regularly approached in a consultation role on issues with products and lenders and on product development. He is also a member of the Standards Committee responsible for developing the Equity Release Council’s consumer safeguards and has in-depth knowledge of all of the current lender legal practices and products.
