The Chartered Insurance Institute’s virtual AGM

The FCA have found following a thematic review that vulnerable customers are often not treated fairly. In fact many Insurers pricing models have taken significant advantage of these customers, often the more vulnerable the customer the more the insurer has loaded rates at renewal. Some of the UK's largest institutions have been guilty of proactively targeting these individuals and the regulator has had enough of Insurers and brokers balancing their books on the most vulnerable in our society. The FCA have announced they will be investigating dual pricing, a lot of this will because the advantage taken of the vulnerable - expect some serious action by the FCA.

Whiplash reform was first proposed more than five years ago. The Civil Liability Act 2018 provided the necessary legal framework but developing the fine detail inevitably slipped because of the Covid crisis. The reforms are now on track and take effect from 31 May 2021. Webinar - The Death of the Orient-Express: a new train of thought on proximate cause?

On 15 January 2021, the Supreme Court held in the FCA Test Case that the Orient-Express Hotels case had been wrongly decided. Proximate cause has long been an issue that the courts have grappled with and as a result this has caused confusion and uncertainty throughout the insurance industry. In this webinar, Jeff Heasman will use his vast experience as a lecturer in tort law and insurance law to strip proximate cause back to the basic principles, trace its development up until the Supreme Court decision on 15 January 2021 and then provide views on what impact the decision will have on underwriting considerations going forward.
