On 19 February 2021, the Supreme Court delivered its judgment in the Uber test case. The decision will have major ramifications for the so-called “gig economy”, and in turn, future underwriting considerations. The Supreme Court judgment provides guidance on when the law now considers someone to be a “worker” and when someone is deemed to be “working”. Furthermore, when combined with an analysis of the Supreme Court judgments in April 2020 relating to an employer´s vicarious liability for their employees, the ramifications are potentially massive.
