Our October CPD presentation: THE AGE OF UNREASON Vulnerable clients; understanding capacity and powers of attorney – As the world grows richer and older mental illness is becoming more common. Understanding how to provide a service to those with limited capacity is vital for you and your businesses, whether you are providing insurance or financial products. A presentation by Sharon Richardson, Director Solicitor and Belinda Poulter, Associate Solicitor of Crombie Wilkinson on behalf of the Insurance Institute of York. Overview Diseases of the mind are best understood as something that a large minority of people can expect to experience at some point in their lives. However, mental illness does not remove their need for financial protection for their possession or liabilities or the need to have financial products. You have to understand the limitations of their capacity, who is supporting and helping them and whether they have the legal capacity to enter into a contract. If a client lacks capacity the responsibility on advisers is greater and how the public views our profession will be based on the quality of the advice and guidance this vulnerable group receive. Learning objectives By the end of the presentation you will gain an understanding of: • what is a vulnerable client and the issues of capacity • what do we mean by lack of capacity • alerts to capacity dealing with concerns and abuse • the difference between an Enduring Power of Attorney and a Lasting power of Attorney • using Lasting Power of Attorney in day to day investment and insurance scenarios • errors that occurs in Lasting Power of Attorney Speakers’ biographies Sharon is a qualified solicitor and a director of Crombie Wilkinson. She is a specialist in most aspects of private client work including:- • Wills • Probate • Personal Tax Planning • Discretionary and Lifetime planning through the use of Trusts and Wills • Estate and Trust administration • Lasting Powers of Attorney and registration of Powers of Attorney at the Court of Protection • Court of Protection Deputyships • Court of Protection Receiverships Sharon is a bereavement volunteer with Cruse Bereavement Service Belinda is an Associate Solicitor at Crombie Wilkinson specialising in private client matters relating to the making of Wills and associated tax planning, continuing trusts, administration of deceased’s estates, Lasting Powers of Attorney and Court of Protection work. Both are members of the national association 'Solicitors for the Elderly' (SFE) and members of STEP (Society of Trust and Estate Practitioners). STEP is an organisation whose members are professionals specialising in the administration of estates, trusts and related taxes. They are members of Dying Matters, an online resource giving advice and support to people by raising awareness of dying, death and bereavement.
