Proximate Cause and Exclusions: the Court of Appeal provides further guidance

In January 2023 the Court of Appeal delivered its judgment in the case of Brian Leighton (Garages) Ltd v Allianz Insurance Plc. This was followed by the Court of Appeal´s judgment in The University of Exeter v Allianz Insurance Plc.

These cases provide further guidance as to what should be taken into account when considering scope of cover and especially proximate cause and exclusions.

In this session, Jeff Heasman will examine the key aspects of the judgments and their impact on insureds and insurers.
