An Overview to the Building Safety Act 2022

The presentation will give an overview of the Building Safety Act 2022 which was enacted earlier this year and will include the following:

  • The Act introduces a regime overseen by a new Building Safety Regulator, with particular emphasis on "higher-risk buildings".
  • There are new obligations that apply throughout a building's life cycle.
  • There are new requirements relating to the competence of those involved with buildings (including the residents themselves).
  • The Act introduces means of enforcement for breach, including criminal sanctions, together with an extension of the limitation periods for civil actions.
  • Beyond all of that the Act provides a framework for a host of secondary legislation which will be introduced over the coming months and which applies to changes to the rules governing architects' competence, fire safety legislation and construction products, a New Homes Ombudsman.
